Terms of Use

These Terms govern the use of the Pulse application and platform provided by Data2Drive Solutions S.L. By using Pulse, your organization and its users agree to these Terms.
1. What Pulse is
Pulse is a process-management platform for construction and service businesses that runs inside Microsoft 365 (Teams, SharePoint, Outlook). Pulse is provided on a subscription basis (a "seat" per user), with optional implementation and configuration services.
2. Accounts and access
Sign-in is performed through your organization's Microsoft account (single sign-on). The organization's administrator controls which users get access and which roles are assigned to them. You are responsible for safeguarding access and for the actions of your organization's users.
3. Subscription and payment
Access is provided subject to an active subscription. Pricing is determined by seat type (roles) and the number of users and is set out in the commercial proposal or contract with your organization. Implementation services, if any, are paid for separately according to an agreed estimate.
4. Acceptable use
- Do not use Pulse for unlawful activity or to infringe the rights of third parties.
- Do not attempt to disrupt the operation, security, or integrity of the service.
- Do not grant access to persons outside your organization without the appropriate rights.
- Comply with the Microsoft 365 terms of use for the integrated services.
5. Your data and content
Your content (documents, files, communications, events) stays in your Microsoft tenant and belongs to your organization. Pulse processes data to the extent described in the Privacy Policy. We do not claim ownership rights to your content.
6. Intellectual property
The Pulse platform, its code, design, and trademarks belong to Data2Drive Solutions S.L. The subscription grants the right to use the service but does not transfer any rights to the product itself.
7. Service availability
We strive to keep the service running reliably but do not guarantee uninterrupted 24/7 availability. Planned maintenance and circumstances beyond our control are possible (including dependence on Microsoft services). Target support parameters are described on the Support page.
8. Limitation of liability
The service is provided "as is." To the extent permitted by law, we are not liable for indirect or consequential damages. Our aggregate liability is limited to the amount paid by your organization for the subscription for the period in which the basis for the claim arose.
9. Term and termination
The Terms remain in effect for the duration of the subscription. Upon termination, you retain access to your content in Microsoft. Process metadata is handled in accordance with the Privacy Policy.
10. Changes to the terms
We may update these Terms; we will notify your organization of material changes. Continued use of the service constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of Spain, unless otherwise expressly agreed in the contract with your organization.
